Risk Warning (Under Section 5M of Civil Liability Act 2002) Issued on behalf of MLC School
MLC School organises many recreational activities within and beyond the curriculum during the course of a year (‘Activities’).
MLC School expects students to behave in a safe and responsible manner and to comply with the MLC School Code of Conduct and to take responsibility for their own safety by wearing any compulsory safety equipment and by behaving in a safe and responsible manner.
While MLC School takes measures to make the Activities as safe as reasonably possible for participants, there is a risk that students can be injured and suffer loss (including financial loss) and damage as a result of their participation in these Activities. A risk of harm can arise as a result of a variety of causes, actions or situations whilst participating in these Activities. Parents, spectators and officials could also be injured or suffer loss.
Such injury can occur while the students are engaging in or watching the Activity or travelling to or from it. The injury may result from a student’s actions, the actions of others, the actions or inaction of any of MLC School or activity provider, the state of the premises or equipment failure. Such injuries can occur when the students are engaging, or watching the activity or travelling to and from the event.
On some occasions, an injury can be serious (such as torn ligaments, dislocations, back injuries, concussion or broken bones) and result in permanent disability. If a student has a pre-existing injury, participating in an Activity may exacerbate that condition.
Students could also suffer loss as a result of their personal property being lost, stolen, damaged or destroyed.
By submitting this Consent in respect of the specific Activity:
- You have read and understood this Risk Warning and you consent to the student participating in it.
- You have provided to MLC School all updated student medical information that may be relevant to it.
- You have acknowledged and accepted that the Activities may be hazardous.
- You have acknowledged and accepted that the School make no guarantees as to the current or future condition of the property or the facilities.
- You have acknowledged and accepted that these conditions may result in increased risk of harm.
